Skilled Employer Sponsored Regional (Provisional) Visa (Subclass 494)

Regional employer sponsorship • Provisional skilled visa • Usually valid for 5 years

The subclass 494 visa allows eligible employers in designated regional Australia to nominate skilled workers for genuine regional roles. It is a provisional visa with regional conditions and a potential, but not guaranteed, later permanent residence pathway.

Is the job in an eligible regional area?

Regional eligibility depends on the officially designated area and relevant postcode. Much of Australia outside Sydney, Melbourne and Brisbane is classified as designated regional for skilled migration purposes, but do not guess from a city name: verify the official designated regional postcodes for the actual job location. The employer’s genuine nominated position and where work is carried out both matter.

Employer Sponsored and Labour Agreement streams

Employer Sponsored stream: requires an eligible occupation, an appropriate regional nomination and usually a relevant skills assessment, experience and English proficiency. Labour Agreement stream: depends on a valid agreement and its terms; exemptions and concessions differ. This guide focuses on the employer-sponsored stream.

Applicant eligibility considerations

  • A nomination for an eligible skilled role in a designated regional area by an approved work sponsor.
  • Generally at least three years of relevant employment at the required skill level for the nominated occupation.
  • A suitable skills assessment unless an exemption applies.
  • Usually under 45 at the time of application, subject to specific exemptions.
  • Applicable English requirements and any occupational registration or licensing.
  • Health, character and relevant previous visa conditions.

Employer requirements and the application journey

  1. Confirm that the workplace and nominated occupation meet regional and occupation-list requirements.
  2. Assess the sponsor business, nominated position, remuneration and whether the role is genuinely required.
  3. Prepare labour-market testing and salary evidence where applicable and consider any regional certifying body requirements.
  4. Lodge the employer nomination and arrange appropriate sponsorship status.
  5. The applicant assembles occupation, skills, experience, English, identity and family evidence and applies.
  6. Comply with post-grant regional and employer-related conditions; keep evidence of residence, employment and taxable income.

Documents for both parties

Employer

  • Australian business registration and operating evidence and sponsorship status.
  • Regional worksite address and supporting position documentation.
  • Employment contract, salary and market-rate comparison, organisational and recruitment evidence.
  • Relevant nomination, regional certifying body or labour agreement records.

Applicant

  • Passport, relevant CV, qualifications and full-time skilled-employment evidence.
  • Skills assessment and English evidence where required.
  • Professional registration, health and character evidence and family documents.
  • Evidence supporting any claimed exemption to the usual age or assessment rules.

How does the 494 relate to subclass 191?

A granted subclass 494 is generally valid for five years. Eligible holders may be able to seek subclass 191 permanent residence after holding a relevant visa for at least three years and meeting its own conditions. The subclass 191 Regional Provisional stream requires ATO notices of assessment for three income years out of the five years of eligible visa holding; there is no minimum income threshold. Check all regional and other visa conditions. The 494 is not permanent residence by itself.

Issues to avoid

  • Assuming any country town or outer suburb automatically meets the official regional definition.
  • Choosing a job title without matching duties and occupation eligibility.
  • Ignoring salary thresholds, market salary or licensing requirements.
  • Treating casual employment as though it necessarily satisfies the three-year relevant experience rules.
  • Assuming a three-year stay guarantees permanent residence.

Frequently asked questions

Can Adelaide-based employers use subclass 494?

Possibly, if the actual nominated work location and all other employer and worker criteria meet the current designated regional and nomination rules.

Do all applicants need a skills assessment?

A suitable skills assessment is generally required in the Employer Sponsored stream unless a valid exemption applies.

Can a 494 holder live and work anywhere in Australia?

No. The visa imposes relevant designated regional-area and employment conditions that must be checked in the grant.
